BOOKING TRAVEL / LMIA LABOR IMPACT ASSESSMENT ASSESSMENT
What is a labor market impact assessment (LMIA)?
NOTE: LMIA OFFICIALLY CALLED THE LABOR MARKET COMMENT (LMO)
A labor market impact assessment, LMIA, is a legal document issued by the Canadian government to employers. LMIA will allow the applicant, a skilled worker, to obtain a work permit in Canada.
The Government will issue negative or positive LMIA to employers after applying. Employees can use LMIA to apply for work permits in Canada.
What are some disadvantages of labor market impact assessment?
It may be difficult to meet all requirements and convince the government that no other Canadian citizen does this job.
Remember that the Labor Market Impact Assessment is issued based on current LMIA needs. For example, if you want to provide a job with a job with a high unemployment rate, then you cannot easily assess the impact of the labor market.
Employers should advertise a job position even if there is a permanent employee for that position. This is to prove to the Canadian Service, the Federal Government that the right efforts have been made to find a Canadian citizen for the job. By advertising, you can get more Canadians to apply for this position.
Things you need to know about Labor Market Impact Assessment: LMIA:
Employers should select a job title and related NOC number from the list provided by Service Canada.
The impact of labor market impacts is also highly dependent on the salaries offered.
Labor community participation and recruitment efforts may also play a factor.
Employers should advertise positions that accurately reflect the needs of employers.
Employers and employees should provide a supporting job description for the intended applicant. The description should include the area of expertise that the employee has. However, the field of expertise is not an unfavorable skill for Canada.
Employees should also demonstrate that they can transfer their skill set to Canada and can provide appropriate training to Canadian staff, if needed. This ensures that employees are contributing to the Canadian workforce.
Remember that it takes some time to process your work permit, so make sure that this is taken into account when considering your intended start date.
The main concern of Service Canada is that employees are not paid well. Therefore, employers should provide appropriate wages according to the current salary. If the employer is willing to go above this salary, the application has a higher chance of success.
Employers should advertise jobs according to NOC requirements.

Determine whether the entry of foreign workers is likely to affect the ongoing labor dispute resolution.
Please note that for certain occupations, you (the employer) may also be required to submit a labor contract that will be considered part of the Labor Market Impact Assessment.
CHANGES TO LMIA
Before assessing the impact of the labor market, this process is called the Labor Market Opinion. On June 20, 2014, the Minister of Labor and Social Development, and the Minister of Citizenship and Immigration, announced important changes toTemporary Foreign Worker Program of Canada.
Under the new rules, the Labor Market Opinon will now be replaced by the Labor Market Impact Assessment ("LMIA"). Foreign workers exempted from LMIA will become part of the newly named International Mobile Program. Therefore, the Temporary Foreign Worker Program will only address foreign workers who need LMIA.
FOLLOWING ARE THE CHANGES MADE TO THE LMIA PROGRAM:
The new labor market impact assessment is more comprehensive and more stringent than the previous Labor Market Opinion process. Employers will be particularly required to provide more documents, including details regarding the number of Canadians applied for the job in question and the number of interviews, as well as explanations. about why they were not recruited.
The fee for employers requiring approval for a foreign worker working in Canada will increase from $ 275.00 to $ 1000.00.
Employment and Social Development Canada will refuse to handle labor market impact assessment applications in the areas of Housing, Food Services and Retail Trade in areas with unemployment rates from 6% or more.
A limit exists on the number of temporary, low-paid foreign workers that any employer can have at a percentage of their overall workforce.
Lower wage positions will no longer be defined by the National Occupation List. Instead, it will be based on the province's average hourly wage.
The duration of any given work permit will be reduced from two years to one year, forcing employees to reapply for a work permit.
There will be some maximum reductions for low-skilled foreign workers.
A new fast-track option will be available in high-demand occupations, highest-paid jobs and short-term jobs for "above-average" salary jobs.
Employers seeking to hire high-paying temporary workers will be required to submit a transition plan to demonstrate they will increase their efforts to hire Canadians, including through higher wages, investing in training. create and actively recruit efforts in the Canadian labor market.
The farm primary stream will be exempt from the limit, with reduced time and higher fees.
The Direct Caregiver Program, which facilitates entry to Canada, is subject to a new $ 1,000 fee but not subject to general limits or reduced timelines, despite other program reforms This specific is coming soon.
Although all these changes have not been implemented, they will undoubtedly be implemented.
