Humanitarian and compassionate bases

Ordinary people who are not eligible to become permanent residents of Canada can apply for humanitarian and compassionate bases.

Humanitarian grounds and compassion apply to those with special circumstances. We evaluate these applications on a case by case basis. Factors we consider include:

Other rules that apply to humanitarian and compassionate bases:

You can only ask humanitarian and compassionate grounds if you are applying for permanent residence in Canada, or applying for a permanent resident visa abroad. We will not consider H&C requirements from permanent applicants.

You cannot have more than one humanitarian and compassionate grounds application at the same time.

We will not assess risk factors such as abuse, risk to life, cruel and unusual treatment or punishment.

You cannot apply for humanitarian and compassionate grounds if you have asylum requests pending. If you want to apply, you must withdraw your asylum request before the Canadian Immigration and Refugees (IRB) hearing.

You cannot apply for humanitarian and compassionate grounds if you have had a negative decision from the IRB within the past 12 months. This is called the bar a year. (If the IRB decides your asylum claim is dropped or withdrawn, it is considered a negative decision.) The bar does not apply if:

Children with children under the age of 18 will be adversely affected if you are removed from Canada, or

Do you have evidence that you or one of your dependents has a life-threatening medical condition that cannot be treated in your country.

Designation of foreigner

You cannot apply for humanitarian and compassionate bases until five years have passed since:

The IRB has made a final negative decision on your asylum claim and / or

You have a negative decision on risk assessment before elimination.

If you apply for humanitarian and compassionate grounds and then become a designated foreign citizen, your humanitarian and compassionate grounds application will be suspended for five years from the date of:

You have been specified, or

About a negative decision from IRB, or

Of a risk assessment decision before removing negative.

If you have an order to leave Canada (this is called a removal order), you can apply for a stay in Canada on compassionate and compassionate grounds, unless any of the above restrictions apply.

If you apply, this will not prevent or delay your departure from Canada. You must leave on or before the date stated in your delete order. We will still process your application even if you must leave Canada. We will let you know in writing about your case decision.

There is no guarantee that we will approve your application. There is no right to appeal an application for refusal to permanently reside on a humane and compassionate basis. In some cases, you can ask the Federal Court of Canada to reconsider a decision.
